Terms of Use
Last updated: 2 November 2026
These are the rules for using Ever Nest. We’ve tried to keep them short and plain. By using the app you agree to them.
The short version
- Be kind to the people in your home, and don’t misuse the app.
- What you add is yours. You let us store and process it to run the app.
- Coins are play money inside the app. They have no cash value.
- Plus is an optional subscription, billed by Apple or Google. You cancel it in your store settings.
- Ever Nest is provided as it is. Don’t rely on it for anything where a missed reminder could cause harm.
1. Who we are, and accepting these terms
Ever Nest is published by Continuum AI, a sole proprietorship (“we”, “us”). By downloading, opening or using Ever Nest on iOS or Android, you agree to these Terms of Use and to our Privacy Policy. If you don’t agree, please don’t use the app.
You must be at least 13 to use Ever Nest. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.
2. What Ever Nest is
Ever Nest lets the people who live together share tasks, a shopping list, reminders and pets, inside a 3D version of their home built from a floor plan. People earn coins for finishing tasks, and spend them on furniture and decor. We may add, change or remove features over time.
Some features use AI. For example, we read the floor-plan photo you add to build your rooms. AI can get things wrong. Check the result and fix it by hand in the editor.
3. Accounts and homes
- You can start as a guest, or sign in with Apple or Google. A guest account can be lost if you delete the app or sign out. Link a sign-in to keep it.
- Give us true information and keep your sign-in secure. You are responsible for what happens under your account.
- A home is shared. The people in it can see and change its tasks, lists, floor plan, pets, History and shop items, as the app allows. Invite only people you trust. Anyone with an invite link or code can ask to join, and a member approves the request.
- You can leave a home or delete your account in the app at any time (Settings, then Account).
4. Your content
“Your content” is what you add to Ever Nest: names, tasks, lists, notes, emoji, plans, photos you submit for floor-plan reading, and feedback. You keep ownership of it.
To run the app, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and display your content, and to show it to the other members of your home. We use it only to provide, secure and improve Ever Nest, as described in the Privacy Policy. This licence ends when you delete the content or your account, except for copies that stay in backups for a short time, and past Dones that remain on a home’s History without your name.
You promise that you have the right to add your content, and that it doesn’t break the law or anyone else’s rights.
5. Acceptable use
Please don’t:
- use Ever Nest to harass, threaten, spy on or hurt anyone, or to post anything unlawful, hateful or sexually explicit;
- add someone to a home, or send them notifications, in a way that is meant to bother them;
- upload photos you have no right to use, or photos that are not a floor plan, to try to misuse the plan reader;
- try to get around limits, break or probe our systems, scrape the service, reverse engineer the app, or use bots or scripts;
- cheat to get coins, for example by faking Dones, or exploit bugs, and then not tell us;
- sell, rent or share your account, or buy and sell coins or items for real money outside the app.
We may limit, suspend or remove accounts or content that break these rules or put others at risk.
6. Coins, levels and the shop
- Coins are a virtual item in the app. You earn them by finishing tasks and from things like level-ups. You spend them on furniture, decor and other pieces for your home, and on real-life rewards that members make for each other.
- Coins have no cash value. They are not money, can’t be exchanged for money, and can’t be transferred to another person or account, other than the sharing the app itself provides inside a home. We don’t buy them back.
- Depending on how your home is set up, coins are kept per person or pooled for the home. Things you buy with coins belong to the home.
- We may set daily limits, change prices and rewards, or correct coin balances, for example when a Done is undone or after a bug. A balance can go down when a Done is undone.
- Coins and items have no value outside Ever Nest. If an account or home is deleted, its coins and items are deleted with it, and we won’t refund or replace them.
- Real-life rewards (like “ice cream night”) are promises that members make to each other. We are not a party to them and don’t provide or guarantee them.
7. Ever Nest Plus (optional subscription)
The core of Ever Nest is free. Plus is an optional paid plan that unlocks extras, such as more furniture and decor looks and other features shown on the paywall in the app. The paywall shows the current price, length and what is included before you buy.
- Who gets it. Plus is bought by one person for their home, and the other members of that home get the Plus features while it is active.
- Billing. Plus is billed by Apple (App Store) or Google (Google Play), not by us. Payment is charged to your Apple Account or Google account when you confirm the purchase. Prices include or exclude taxes as the store shows.
- Auto-renewal. A subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. The store charges your account for renewal within 24 hours before the period ends.
- Free trial. If a free trial is offered, it is shown on the paywall. If you don’t cancel before it ends, you are charged for the first period.
- Other plans. If we offer a one-time purchase instead of a subscription, the paywall says so, and it doesn’t renew.
- Cancel or manage. On iPhone: Settings, then your name, then Subscriptions. On Android: Google Play, then Payments & subscriptions, then Subscriptions. Deleting the app does not cancel it. If you cancel, Plus stays on until the end of the period you paid for.
- Refunds. Apple and Google handle refunds, under their own rules. Ask them through your store’s “Report a problem” or refund page. We can’t refund store purchases ourselves.
- Restore. If you changed phones, use Restore on the paywall.
- Changes. We may change Plus features and prices. A price change applies at your next renewal, after the store has told you and asked for consent where it requires that.
8. Apple and Google
If you got Ever Nest from the App Store, these terms are between you and us, not Apple. In addition, the Apple Standard End User License Agreement (“Licensed Application End User License Agreement”) applies to your use of the iPhone app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple has no duty to provide maintenance or support for the app, and is not responsible for any claims about it. If the app fails to meet a warranty, you may tell Apple, and Apple may refund the purchase price, if any, and otherwise has no warranty duty to you.
If you got Ever Nest from Google Play, Google’s Play Terms of Service also apply. Your use of Apple, Google and other third-party services (for example sign-in, push notifications, speech recognition) is also subject to their terms.
9. Our property
The app, its 3D scenes, furniture, characters, animals, text, design, name and logo belong to us or our licensors and are protected by law. We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on your own devices under these terms. You may not copy, sell, modify or build on any part of it, except as the law allows or where we give you permission.
If you send us feedback or ideas, we can use them without paying you or crediting you.
10. No promises about the service
Ever Nest is provided “as is” and “as available”. To the extent the law allows, we do not promise that it will be uninterrupted, error-free or secure, that reminders and notifications will always arrive on time, that the floor-plan reading will be accurate, or that any data will never be lost. Notifications depend on your phone, your settings and third-party services.
Ever Nest is for everyday household planning. Do not rely on it for anything where a missed or late reminder could cause harm, such as medication or safety checks.
11. Limits on our responsibility
To the fullest extent the law allows, Continuum AI is not liable for indirect, incidental, special, consequential or punitive losses, or for lost profits, data or goodwill, arising from your use of Ever Nest. Our total liability for any claim related to the app is limited to the greater of the amount you paid us (through the store) in the 12 months before the claim, or USD 50.
Nothing in these terms limits liability that can’t be limited by law (for example for fraud, or for death or personal injury caused by negligence), or takes away rights you have as a consumer where you live.
12. Ending your use
You can stop using Ever Nest at any time, and delete your account in the app. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering the service. If we end the service, we will try to give you notice. After termination, the sections that should survive (such as content licence for backups, intellectual property, disclaimers, limits on responsibility and governing law) will continue to apply. Ending your account does not cancel a store subscription. Do that in your store settings.
13. Governing law and disputes
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts of Vancouver, British Columbia will decide any dispute, unless the law where you live gives you the right to bring it elsewhere. Please contact us first so we can try to fix the problem.
14. Changes to these terms
We may update these terms as Ever Nest changes. We will change the date at the top, and tell you in the app or by email if the change is important. If you keep using Ever Nest after the change takes effect, you accept the new terms. If you don’t agree, stop using the app and delete your account.
